| Barry
is a seasoned franchise lawyer and executive, with a keen
awareness of the nuances of the franchisor-franchisee relationship.
Barry spent ten years as a senior executive
at Burger King Corporation, in legal and franchising roles,
preceded by fifteen years in private law practice with
an emphasis in franchise matters. He is also a Florida
Supreme Court certified mediator, and he serves as an arbitrator
for the American Arbitration Association.
Barry has handled significant matters in all aspects of
franchising. In addition to franchise litigation
experience, both as counsel and business client, Barry
has developed solutions for financially-distressed franchisees,
negotiated and executed purchases and sales of franchise
businesses, and has overseen recapitalizations of franchise
businesses.
He has also structured and implemented
an international master franchise arrangement, managed
supply and distribution relationships through critical
periods, and directed key franchising functions, including
approval of new franchisees, initiatives to increase
minority franchisee ownership, and programs and incentives
to increase franchise agreement renewal rates.
His past successes are attributable in large part to his
relationship management skills. He “gets it” when
it comes to franchising. He has earned the highest
rating of “AV” from his peers in the Martindale-Hubbell
Legal Directory, and was named a 2007 “Legal Eagle” in
Franchising as reported in Franchise Times magazine.
Before joining Burger King Corporation in 1997, Barry
was a partner in the Miami, Florida law firms of Blum Perlman & Cherdack,
Schulte Blum & Joblove, P.A. and Tew Jorden & Schulte,
P.A. As a founding partner in two law firms
concentrating on business litigation, Barry had significant
experience in the areas of franchise, distribution and
licensing litigation and arbitrations.
Barry is a frequent speaker at franchise and professional
conferences, and he has participated on numerous panels
related to legal issues and legal department management. He
has also written for a number of franchise and legal publications.
